　　凡因本协议引起的或与本协议有关的任何争议应协商解决。若协商不成，应提交华南国际经济贸易仲裁委员会，按照申请仲裁时该会现行有效的仲裁规则进行仲裁。仲裁裁决是终局的，对双方均有约束力。

　　AnydisputearisingfromorinconnectionwiththeContractshallbesettledthroughfriendlynegotiation.Incasenosettlementisreached,thedisputeshallbesubmittedtoSouthChinaInternationalEconomicandTradeArbitrationCommission(SCIA)forarbitrationinaccordancewithitsrulesineffectatthetimeofapplyingforarbitration.Thearbitralawardisfinalandbindinguponbothparties.

　　第一条代销车辆的基本信息

　　第二条代理费支付时间、方式

　　第四条代销期限

　　第六条双方事先约定事项

　　第七条甲方的权利和义务

　　(一)、所提交的证件资料真实、合法、有效，并完全拥有所有权或处置权。

　　(二)、因甲方原因造成车辆不能过户或转籍，甲方无条件接受第三方(买方)退回的车辆，并向乙方支付双倍代理费和因此发生的过户费用;因车辆本身原因造成车辆不能过户或转籍，甲方无条件接受第三方(买方)退回的车辆，并向乙方支付全额代理费和因此发生的过户费用。

　　(三)、在合同期内，甲方不得随意提取、自行或委托他人出售该车辆，否则乙方有权单方解除合同，并要求甲方支付全额代理费和因此实际发生的费用。

　　(四)、车辆在交接之前的所有交通事故责任、违章罚款、债务等由甲方承担，若车辆销售成功，甲方承担的责任不因合同的终止而终止。

　　(五)、甲方到场办理，并提供以下有效证件：身份证原件、其他证件：______。

　　(六)、甲方承担车辆过户税费(凭发票实报实销)。

　　第八条乙方的权利和义务

　　(一)、若合同期内车辆未能售出，已经发生的费用由乙方自己承担。

　　(二)、在合同期内，乙方应妥善保管甲方交给的车辆、各种证件、文件和资料。

　　第九条合同的变更、解除、终止

　　(一)、合同期内任何一方需要变更合同，应提前三天以书面形式通知对方，经双方协商同意后另行签订补充合同，补充合同具有同等法律效力。

　　(二)、合同期内需要解除合同，须经双方一致同意。否则，单方解除合同视为违约，并承担违约责任。

　　(三)、合同期满后，合同自然终止，双方办理相关车辆交接手续。经双方协商需要续签合同的，应在合同期满前一天办理续签手续。

　　第十条违约责任

　　任何一方违反本合同约定，须向对方双倍支付代理费作为违约金，并承担因此给对方造成的一切经济损失和相应的法律责任。

　　第十一条解决合同纠纷的方式

　　双方发生合同争议时，可向仲裁委员会申请仲裁。

　　第十二条其它约定

　　(一)、本合同一式两份，甲、乙双方各持壹份。

　　(二)、本合同自双方签字或盖章后生效。
